Terms of Use

In short: DopplerNav is a free early-access weather tool made by storm chasers. Use it for yourself, keep your account to yourself, don't misuse it, and never treat it as an official warning. It comes with no guarantees, and our liability is limited. The full terms are below.

1. Agreeing to these terms

These Terms of Use ("Terms") are an agreement between you and DopplerNav Technologies LLC ("DopplerNav", "we", "us"), the operator of the service at dopplernav.com, including the radar app, the website and anything else we offer under that name (together, the "Service"). By creating an account, by signing in after we ask you to accept these Terms, or by using the Service, you agree to them and to the other policies that apply to you:

the Privacy Policy, which explains what we collect and why;
the Safety & Weather Disclaimer, which explains what the Service is not; and
the Acceptable Use & Data Sources policy, which sets out what you may not do and credits the agencies whose data you see.

If you do not agree, do not use the Service. You can close your account at any time (section 9).

2. Who may use it

You must be at least 13 years old. If you are under 18, you may use the Service only with the permission of a parent or guardian, who is responsible for your use of it. You must be able to form a binding agreement where you live, and you must not have been barred from using the Service.

3. Your account

Give us a real name and an email address you control, and keep them accurate. We confirm your email with a code before the account works.
Your account is for you. Do not share your password, and do not let others sign in as you. You are responsible for what happens under your account.
Choose a password that you do not use elsewhere. Tell us promptly at support@dopplernav.com if you think someone else has access.

4. Early access, and what it costs

The Service is in early access and is free to use today. It is under active development: features will appear, change and disappear, data sources will come and go, and the Service may be slow, wrong or unavailable at times. We may introduce paid plans later. If we do, we will tell you first, and you will not be charged for anything unless you choose a paid plan and agree to its price. Some features that are free now may move into a paid plan.

All camera features will remain in the Free plan, including live video, snapshots, nearby discovery and pinned cameras. Cameras remain subject to the availability and terms of their providers.

If sandbox billing is available, it is clearly labelled as a test and uses Stripe test transactions. It does not create real charges, and its test prices are not announced launch prices. All current features remain available during early access.

5. What you may do with the Service

We give you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own purposes, in line with these Terms and the Acceptable Use policy. We keep all rights we do not expressly give you. The software, design, text and compilation of the Service are ours or our licensors'; the weather, camera, traffic and other data shown are the property of the agencies and organisations that publish them, and remain subject to their terms (see Acceptable Use & Data Sources).

6. Weather safety

DopplerNav is an information tool. It is not an official source of warnings, it can be late, incomplete or wrong, and nothing in it is a substitute for the National Weather Service, local emergency management or your own judgement. Storm chasing is dangerous. You use the Service, and decide where to go and when, entirely at your own risk. Do not operate it while driving. Please read the Safety & Weather Disclaimer in full; it forms part of these Terms.

7. Third-party data and services

The Service displays and relies on data and services from others: government agencies, transportation departments, map and imagery providers, flight-data networks and our own hosting providers. We do not control them, we do not guarantee them, and we are not responsible for their accuracy, availability or content. Links and video streams that lead to a third party's servers are governed by that party's terms and privacy policy.

8. Feedback

If you send us ideas, bug reports or suggestions, we may use them without obligation or payment to you. Please do not send anything confidential.

9. Ending your access

You may stop using the Service at any time. To delete your account and the personal information we hold about it, email support@dopplernav.com from the address on the account; we will act on it within 30 days. We may suspend or end your access, with or without notice, if you break these Terms or the Acceptable Use policy, if your use puts the Service or others at risk, if we are required to by law, or if we end the Service. Sections that by their nature should continue (including 5, 6, 10 to 13) will survive.

10. No warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", FREE OF CHARGE, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF ACCURACY, TIMELINESS, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT ANY WARNING, FORECAST, RADAR PRODUCT, CAMERA IMAGE, POSITION OR OTHER INFORMATION SHOWN IS CORRECT OR CURRENT, OR THAT THE SERVICE WILL BE AVAILABLE WHEN YOU NEED IT.

11. Limit of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE AND THE PEOPLE WHO BUILD AND OPERATE THE SERVICE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, PROPERTY, OPPORTUNITY OR GOODWILL, OR FOR ANY INJURY, DEATH OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, OR ANY RELIANCE ON INFORMATION IN IT, EVEN IF WE HAVE BEEN ADVISED THAT SUCH LOSS IS POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100).

Some places do not allow certain exclusions or limits, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

12. Your responsibility to us

You agree to defend and reimburse us for claims, losses and costs (including reasonable legal fees) that arise from your breach of these Terms or the Acceptable Use policy, or from your use of the Service in a way the law or these Terms do not allow. We will tell you promptly about any such claim and let you take part in handling it where that is reasonable.

13. Governing law and disputes

These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict-of-law rules. Before starting any formal proceeding, please email us and give us 30 days to try to resolve the matter informally. Subject to that, any dispute will be brought in the state or federal courts located in Tennessee, and you and we consent to their jurisdiction. If you are a consumer, this does not take away any rights you have under mandatory consumer-protection law where you live.

14. Changes to these Terms

We may update these Terms and our other policies. When a change is material, we will update the date at the top of the page and ask everyone with an account, new and existing, to review and accept the new version before continuing to use the Service. If you do not accept, you will not be able to use the Service and you may close your account. For a change that is not material, such as a correction, the updated page applies from the date shown.

15. General

These Terms, with the policies they refer to, are the whole agreement between you and us about the Service. If a part is found unenforceable, the rest stays in effect. Our not enforcing a right is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours as part of a change of ownership or operation of the Service. We may send you notices about the Service, including these Terms, by email to the address on your account or by showing them in the Service.
